New Jersey & Pennsylvania Volkswagen Defects Attorney

The Volkswagen Group (VW) is a German automaker that was founded in 1937 with the mission of making automobiles affordable for everyday German citizens, which is why it was dubbed “the people’s car.” Today, Volkswagen has become the largest automaker based on worldwide sales and currently produces a number of popular models including the Jetta, GTI, EoS, New Beetle, Passat, Tiguan, Touareg SUV, and many others. Despite boasting precision German engineering, however, numerous VW models have been prone to defects.

Timothy Abeel & Associates, P.C. is the premier consumer law firm serving clients throughout all of New Jersey and Pennsylvania, including Philadelphia, Pittsburgh, and Trenton. If you have purchased or leased a Volkswagen that has been in for multiple repairs while under a manufacturer’s warranty, you may have a Lemon Law claim under applicable state and federal law. Our experienced attorneys have extensive experienced fighting for the rights of consumers and can help you obtain significant compensation.

The VW Emissions Scandal

In 2016, Volkswagen admitted to circumventing the emissions control system in more than half- a-million vehicles sold in the United States with the 2.0-liter diesel engine, and as many as 11 million vehicles worldwide. In short, VW installed emission software that enabled these vehicles to cheat the emissions test established by the Environmental Protection Agency.

In the emissions test mode, the vehicles were fully compliant with federal nitrogen-oxide (NOx) emission standards. Under normal driving conditions, however, the computer switched to a separate mode that changed the fuel pressure, injection timing and exhaust-gas recirculation, permitting NOx emissions far higher than the federal limit.

The company entered into a $14,7 billion settlement with the federal government that included a $10 billion buyback program for about 475, 000 vehicles. Under the deal, owners were given up to two years to collect their compensation, either a buyback at a premium, or a fix by VW if possible.

Volkswagen subsequently entered into a separate agreement concerning vehicles with 3.0 liter diesel engines that had the emissions cheat software. The company agreed to buy back 20,000 of those vehicles, recall 23,000 and pay $250 million to partially settle these claims.

Other Volkswagen Recalls

The emissions scandal has certainly been a black eye for Volkswagen, but the scandal has also grown to include other European automakers. Although the emissions cheat story dominated the headlines, there have been other recalls issued by VW.

  • In May 2017, Volkswagen recalled  84,262 model-years 2012-2014 Passat vehicles equipped with diesel engines and direct-shift transmissions. Underbody heat shields were not long enough to protect the right side axle boot, which could cause a leak of grease and fire hazard. Dealers were instructed to make the needed repairs.

  • In December 2016, the automaker announced the recall of certain model years 2009-2010 Volkswagen Jetta A5 Sedan, 2009 Jetta Sportwagen, Eos, GTI, Rabbit and 2010 Golf A6 vehicles. The Antilock Brake System control unit could fail during activation, causing loss of vehicle control and increasing the risk of a crash. Dealers were instructed to test the ABS control module software and replace as necessary.
