Volvo Seatbelt Recall

If you happen to own or lease a 2017 Volvo XC90 SUV, there's been an auto recall related to its third-row seat belts.

Although there haven't been any accidents or injuries reported yet--and the seatbelt will reportedly still function in the event of an accident-- the defect could cause a piece inside the seatbelt retractor to enter the cabin as a speeding projectile. Specifically, the "right hand seatbelt retractor called a micro gas generator can detach after the seatbelt retractor pre-tensioner is deployed".

The detached micro gas generator can not only become a projectile inside the cabin but can also "enter the luggage area through the trim panel". Volvo’s claim that the detached generator’s travelling through parts of the vehicle will reduce the speed of the projectile is not reassuring.

If you own or lease a vehicle affected by an auto recall, you are entitled to have the defect repaired free of charge at the local dealership.

Sometimes, new vehicles have persistent problems regarding the same defective automotive part or system. If you are repeatedly bringing your newly purchased or leased vehicle in for the same repairs and the problem has “substantially impaired the use, value or safety of the vehicle”, you may be entitled to pursue a lemon law claim.

How long you have to pursue a lemon law claim depends on where you live. A Pennsylvania lemon law action must be commenced within the first one year or 12,000 miles.  The New Jersey lemon law allows claims within the first two years or 24,000 miles.

If your car is found to be a lemon under your state’s lemon law, you may get a full refund of the following:

  • your down payment,

  • trade-in,

  • monthly payments and taxes,

  • or a brand-new car.

Even if your car doesn’t qualify under your state’s lemon law, you may be able to pursue a federal lemon law claim and get a cash settlement.
