Lemon Law PA Claims

Under the Pennsylvania Lemon Law, a new purchased or leased vehicle that has a defect within the first 12 months or 24,000 miles that has not been repaired after a reasonable number of attempts may be considered a lemon. The car must have a substantial defect that decreases its resale value, makes the car unsafe, or impacts the vehicle’s normal functions. If the defect has not been repaired after three attempts, or the vehicle is out of service 30 days or more, you may have a valid lemon law claim. 

It is worth noting that the defect must only be reported once during the one-year/12,000 mile period, which means that the vehicle does not have to be brought in for service three times during that period. Before you pursue a lemon law claim, however, the manufacturer must be notified and given one last chance to repair the defects. If the manufacturer cannot, or refuses to, make the repairs, your lemon law claim can proceed.

Finally, if the defect occurred after the 12 month/12,000 mile timeline, you may still be protected under federal warranty law.

Are used cars covered by the Pennsylvania Lemon Law?

The Pennsylvania Lemon Law does not cover used cars. However, consumers of pre-owned vehicles are protected by federal law -- the Magnuson-Moss Warranty Act. Under this law, it is possible to file a claim for damages for a defective used vehicle and manufacturer’s may be held liable for failure to make the needed repairs. In addition to a refund of the vehicle’s purchase price, aggrieved consumers can also recover legal fees and court costs.
